Read Case 52-2, McDaniel vs. McDaniel, on page 1192.
What were the critical factors identified by the court with respect to undue influence and fraud in this case? How far should courts go to protect the elderly and infirm from undue influence and fraud, especially in cases, such as this one, in which the testator possessed adequate mental capacity at the time of the making of the 2007 will?
Legal Principle: Even when a will is legally valid (i.e., is signed and in writing), individuals can contest the will. For example, they can claim that the will was created under undue influence.
The critical factors identified by the court with respect to undue influence were; was the will properly executed, did that testator (the father) have the mental capacity to create the will, and was it created under undue influence or fraud. (Kubasek, 2017) The fact that the propounder took advantage of this fathers diminished mental capacity to poison his mind against his other son. Convincing him that the caveator stole $600,000 from him and he was now broke. The propounder then used his influence to direct his father to alter the bank account structure and amend his 2002 will. The change in the will profoundly benefited the propounder eliminating the caveator. (Kubasek, 2017)
The courts have a responsibility to protect the vulnerable, elderly, and those with diminished mental capacity. Those that are charged with their care have a fiduciary responsibility to the other. There is also a responsibility on the attorney to check for capacity before proceeding with the creation or altering of the will. Financial institutions also have procedures to help identify potential elder abuse and should be reporting those to the appropriate state agency.
It is unfortunate that the estate planning in 2002 did not include power of attorney appointment or placing the assets in a trust. This would have further defined the individuals fiduciary responsibility to the father.

In the McDaniel Vs. McDaniel case, the critical factors involved found by the Jury and justice Nahmias, is that the propounder and his wife influenced the caveator and his wife to take a “long vacation” in Florida. The propounder then delivered false accusations to Luther and the family accusing the caveator of stealing money and fleeing to Florida. The propounder told Luther that he was now broke. With this news, Luther was in disarray, his mental health was also deteriorating and he now did not trust the caveator resulting in a restraining order. All of this was due to the fact of being under the influence of the propounder.
Luther was showing signs of mental health decline before the new will was even made. Therefore, the will was created under undue influence by the propounder and his wife. The propounder misrepresented Luther and the caveator, and showed fradulant actions. He used Luthers fear and emotions to scare him in to creating a new will. These actions would fall under the category of undue influence.
Honestly, this case is very sad and heart-wrenching to read. I believe courts should go as far as possible to protect the elderly. Maybe implement a double check system when wills are updated after a certain age. I believe the lawyer who helped create the will should have asked more question and have been more involved before altering the will. I would assume he would of raised some eyebrows from the propounders requests. Possibly needing a legal judgement before altering a will after a certain age as well. It is sad that family member would even go so far to do this to their own blood.
