A contractor who is just starting out will often have very little capital. Because of this a new contractor will often not be able to afford legal services for every issue that may arise. As small claims court does not allow professional lawyers to be involved the cost for legal proceedings will be much lower. The fact that the opposing party is also not allowed to have a lawyer present ensures that the new contractor filing in small claims court will have a better chance of a claim being found in their favor. Small claims court may also be all that is required for the average contractor who is just starting out in the industry. These contractors are often only taking jobs that are smaller in scope and can easily be handled by a single individual or in some cases a small crew of employees.
The only reasons that I could see myself personally filing a claim with small claims court would be to recover losses from a personal injury incident. As I am not a business owner and do not plan on pursuing a career as one, I don’t see myself ever needing to file a claim for business purposes. Another situation that could be relevant to me would be to recover something like a security deposit from a landlord if I felt that it was being wrongfully withheld.
