Contractual Indemnity clause should be red flagged in inspecting the construction agreement. Most owners like to exculpate themselves from liability trying to place the entire burden on the contractor. If the owner makes the contractor responsible for all conditions, known or unknown, visible or not visible, the construction firm must decide whether that’s a risk it is willing to take. The Primary and sub-contractors should raise their price and it should be reflected in the bid, in order to mitigate their risk (p.451).
