A recent gang suppression action resulted in several alleged gang members being arrested for possession of firearms. In all instances, a car was pulled over for a traffic violation, the inside of the car was searched, and a handgun was found.

You be the judge during a detention hearing.

A fifteen year old is brought before you. The teenager was in one of the above cars. The District Attorney has charged the teenager with possession of a concealable firearm and with the gang enhancement. A felony that for adults could carry 10 years in prison. The detention report describes a teenager with some attendance problems but no other school conduct issues. This is the first time the teenager has been before you. The teenager’s parents are present and appear to provide a loving and caring home.

Do you detain the teenager? Why or Why not?
