Jean-Jacques Rousseau, “The Origin of Civil Society”-Jeanne Stuart
- To describe the role of the state, Rousseau uses an analogy, that the relation of the people to the state is like that of children to their father. First, explain the analogy; that is, how, according to Rousseau is the relationship between the state and the people like that of a father to children? What kind of parent-child relationship does Rousseau think is the proper role for a government? Then explain whether you think this analogy applies or should apply to the relationship between the people of a nation and their government. That is, should the people of a nation look upon their government as being like a parent to them, and if so, what type of parent-child relationship do you think people should establish with their government?
- Rousseau states that the use of force in establishing the power of the state makes the peoples relation to the state one of Obedience rather than of Duty. What is the difference between Obedience and Duty? Do you think that the relationship between the people and the government is or should be based on Obedience or on Duty? Do you think that the ways laws are enforced in the U. S. relies more on Obedience or on Duty?
- Rousseau explains that Aristotle believed that some people were born to be slaves but that Aristotle had mistaken the effect for the cause. What does this mean?
- What is the difference between natural liberty and an individuals liberty as a member of a civil society (that is, civil liberty)? In what way can a person give up some degree of natural liberty and still be as free under a condition of civil liberty? How can a persons freedom under civil liberty be seen as equal to the freedom under natural liberty?
- Consider your understanding of actual liberties or freedoms that you exercise and the function of a government in relation to those liberties. In what ways is the function of a government necessary for the exercise of liberty and/or the equal access to liberty? In what ways may the function of a government act against a persons liberties?
- How do these two types of liberty relate to a persons right to possession or ownership of property? What is the basic difference between possession and ownership and how does the role of government act in establishing that difference?
- What are the conditions of the right of first occupancy for ownership of property? Are all or any of these conditions met in the ownership of property in our society? How does the authority of the state allow an individual to maintain ownership of property beyond these conditions of first occupancy?
- Rousseau ends the essay by referring to equality, pointing out that people are more truly equal under the law than they are in a condition of nature. How is that so; how can people in a civil society acting under the control of a government and the law have greater equality than they would without such laws?
