After more than ten years, Mark left Allied, taking15,000 pages of Allied’s documents on DVDs and CDs, which constituted trade secrets. Later, he joinedAllied’s competitor, Genesis Equipment & Manufacturing, Inc. Genesis soon developed a piece ofequipment that incorporated elements of Allied equipment. Discussion 2

Professor Wise is teaching a summer seminar in business torts at State University. Several times duringthe course, he makes copies of relevant sections from business law texts and distributes them to hisstudents. Wise does not realize that the daughter of one of the textbook authors is a member of hisseminar. She tells her father about Wise’s copying activities, which have taken place without her father’s orhis publisher’s permission. Her father sues Wise for copyright infringement. Wise claims protection underthe fair use doctrine. In 75 words or more, who will prevail? Explain.
