Probable Cause
Question Description
Hi, You will be reading a fake police report then you should write an affidavit for probable cause. I will provide a template of what it should look like as well as an example of a previous affidavit for probable cause. There are many examples on the internet that you can follow.
In the case i’m providing, the person named JANE DOE is the defendant and was arrested for Possession of Heroin, Possession of Cocaine, and a Warrant.
Here is the police report:
On August 7th, 2020, at approximately 11:46 hours, I (Officer YOUR NAME) was on patrol wearing a full police uniform and driving fully marked squad car.As I patrolled the northwest quadrant of (City Name), I saw a black Astro van traveling south on Well St. from E. State Blvd.I followed the van.At the intersection of Fairfield Ave. and W. Main St., I saw the black Astro van disregard the automatic light signal.
The tint on the driver and passenger windows of the van was so dark that I could not tell how many occupants there were inside, or their gender. The van had a plate of ABC123.I then conducted a traffic stop on the van on the parking lot of the gas station located at the intersection Fairfield Ave. and W. Jefferson Blvd. After the van pulled over, I saw the driver (a male white later identified as JOHN DOE) exit the drivers seat and attempt to walk away from the vehicle. I then observed JOHN DOE drop a plastic baggy containing an off-white substance onto the parking lot ground. I ordered JOHN DOE to stop and return to my location. He complied. From my police training and experience, I suspected the white powdery substance to be cocaine.
At that same time Sgt. Michael made my scene and assisted me.The sergeant advised me that the front right passenger, later identified as JANE DOE, threw items out the front passenger side window.JANE DOE then exited the front passenger seat and ran from the traffic stop, westbound through the parking. Sgt. Michael was able to catch up to JANE DOE and place her into custody.A third subject, BILLY DOE, was in the rear of the van; he was briefly detained as well.
I then recovered the baggy that I saw JOHN DOE drop on the ground.I was able to field-test the white powdery substance and it tested positive for cocaine. It appeared that the combined weight, with the bag, of the white powdery substance was around one gram. While on scene, without asking him, JOHN DOE freely stated that he just “snorts” a little.
Sergeant Michael then pointed out a blue rubber glove, near the gas pump. The blue glove was the item JANE DOE had thrown out the window. After checking inside the blue plastic glove, I observed three small plastic baggies. Two of the clear plastic bags contained a white powdery substance, which later field-tested positive for cocaine with an approximate substance weight of 2.3 grams. The third clear plastic bag contained a brown gravel-like substance, which later field-tested positive for heroin with an approximate substance weight of 3.8 grams.
A BMV check revealed that JOHN DOEs driver status was DWS-Infraction and a warrant check showed that JANE DOE had an active felony warrant out for her arrest from Adams County. The van was towed, and all evidence found was later placed into continuity, for court purposes.JOHN DOE was transported to the Lake County Jail where he was arrested for possession of cocaine. JANE DOE was transported to jail where she was arrested for her active warrant, possession of heroin and possession of cocaine. BILLY DOE was released from the scene. All officers involved were wearing full police uniforms.
