Question Description

I have a discussion home work that has two part

Part One – Please write a paragraph or two on the case you liked or disliked the most in Chapters 6-12 and tell us why. Choose a case that is highlighted in the book – one that covers a page or more. (Don’t choose a “Case in Point” or other case that is mentioned in a paragraph of text – even though it might be very interesting.) Also, identify your case by the case name before you start your comments.

In your comment, briefly summarize the facts, then relate them to the legal concepts we are studying. A summary of the facts and your opinion of “fair” or “not fair” is not a legal discussion. Apply the legal concepts you are studying to what happened in the case. Then you may add your opinion to the decision if you like. This discussion is worth 90 points.

Part Two – Next, read another student’s discussion (the one worth 90 points). Write a paragraph after the student’s entry with additional or contrary points regarding that student’s discussion. This will be worth 50 points to you. (Be respectful!)

A word of caution: In the past, some students have posted on a case and only described the facts and the trial court decision. Don’t forget to summarize the decision of the appellate court case we read.

A second word of caution: In the past, I’ve seen students submit incorrect summaries of a case decision (which is bad – those students lost points). But what was worse is that other students posted on the incorrect summaries – agreeing with the writer! Yikes! Be careful of that. If you think another student has the post wrong, speak up!

Book name: The First Course, 14th Edition

student comment for part two: State of Minnesota v. Smith (Court of Appeals of Minnesota, 2015 WL 303643 (2015)). During Labor Day weekend in Minnesota, two homes and a tennis center were burglarized. The next day, cleaning personnel found a garbage bag with incriminating evidence in the room of Albert Smith. Evidence included a passport from one of the homes and business documents from the tennis center and a Sentry safe. Smith was seen walking through the hotel by the hotel manager during the predicted time frame of the crime. This is an example of burglary and larceny because items were stolen but there was no intent to harm the owner of those posessions (i.e. passport, business documents). Smith defended himself by saying he recieved the stolen goods in the mail while finding others in the dumpster outside of the hotel. In my opinion, Smith was most definetly guilty. All the evidence directly linked him to the crime. I lenjoyed this case because it was straight-forward. From the crime to the ruling, it all was really simple and easy to understand. That is what I struggle with most in reading the case briefs, is understanding step by step what is happening from start to finish.
